Terms of Service

1. Acceptance of Terms
By accessing or using Raid Train Express ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
2. Description of Service
Raid Train Express provides tools for scheduling, curating, and managing raid trains — collaborative live stream sequences on platforms such as Whatnot. The service includes web application features, Chrome extension tools, AI assistant connections, and related services.
3. User Accounts
You must register for an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration.
4. Acceptable Use
You agree not to: (a) violate any applicable laws; (b) infringe upon the rights of others; (c) attempt to gain unauthorized access to the Platform; (d) use the Platform for fraudulent or deceptive purposes; (e) transmit harmful code or content.
5. AI Assistant Connections
You may authorize third-party AI assistants to connect to your account. A connection acts as you: it can access only what your own account can access, and nothing more.
You are responsible for everything done through a connected assistant, including any trains or challenges it creates on your behalf. Actions taken through a connection are subject to these Terms exactly as if you had taken them yourself.
We do not operate or control the AI assistants you connect. Their own terms and privacy policies govern what they do with the information they receive from us. AI-generated summaries, answers, and suggestions may be incomplete or incorrect — the data shown on the Platform itself is authoritative.
You may revoke a connection at any time from your account settings. We may rate-limit, suspend, or revoke connections to protect the Platform, its users, or its availability.
6. Whatnot Data & Third-Party Platforms
The Platform is built around Whatnot usernames. By providing a Whatnot username — for your own account, or when referencing another seller's public account through Platform features — you authorize us to retrieve publicly available information about that Whatnot account (existence, display name, seller status, public metrics, and public show schedule), including through third-party data services, and to refresh that information periodically. We never ask for, receive, or store Whatnot login credentials.
You must provide a Whatnot username that belongs to you. Claiming another person's active Whatnot username is a violation of these Terms and may result in loss of verification or account suspension.
Whatnot metrics shown on your profile can be hidden with the "Show Whatnot Stats" setting in your profile. Verification status remains visible.
Whatnot data is retrieved from public sources on a periodic basis and may be incomplete, out of date, or unavailable. It is provided for convenience and is not authoritative — the Whatnot platform itself is the source of truth for Whatnot account information. Raid Train Express is not affiliated with, endorsed by, or operated by Whatnot Inc., and your use of Whatnot remains governed by Whatnot's own terms of service.
7. Ratings & Community Feedback
The Platform allows participants to rate one another after shared events, such as completed raid trains. Ratings exist to help sellers make informed decisions about who they collaborate with. Every rating you submit must reflect your honest, good-faith assessment of a genuine experience with the person you are rating.
You agree not to misuse the rating system, including by: (a) submitting retaliatory ratings — for example, lowering a rating because someone rated you unfavorably, declined to work with you, or reported a violation; (b) submitting ratings that are fraudulent, fabricated, or not based on an actual shared event; (c) coordinating with others to inflate or deflate a person's ratings; (d) using ratings, or the threat of ratings, to harass, intimidate, or extort another user; or (e) offering or demanding anything of value in exchange for a particular rating.
If we determine, in our sole discretion, that the rating system has been abused, we may take any action we consider appropriate, including removing or adjusting ratings, disabling a user's ability to give or receive ratings temporarily or permanently, and suspending or permanently banning the responsible account. We may take these actions with or without prior notice. Ratings are Platform features, not guarantees — we do not warrant that any rating will be displayed, retained, or included in aggregate scores.
8. Cost of Service
The Platform is currently provided free of charge. We reserve the right to introduce paid features or subscription tiers in the future. If we do, we will provide at least 30 days' notice before any charges apply, and free-tier access to core features will remain available.
9. Content & Intellectual Property
You retain ownership of content you create. By using the Platform, you grant us a limited license to display and process your content as needed to provide the service. The Platform's code, design, and branding are our intellectual property.
10. Termination & Data Deletion
We may suspend or terminate accounts that violate these Terms. You may delete your account at any time through your account settings or by contacting us. Upon receiving a deletion request, we will delete your account and associated personal data in accordance with our Privacy Policy.
11. Limitation of Liability
The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by applicable law, Raid Train Express and its operators, officers, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Platform.
Because the Platform is provided free of charge, our total aggregate liability for any claims arising from or related to your use of the Platform shall not exceed one hundred U.S. dollars ($100.00).
12. Indemnification
You agree to indemnify, defend, and hold harmless Raid Train Express and its operators, officers, and contributors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or transmit through the Platform.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict-of-law provisions. For any dispute not subject to arbitration under Section 14 (including small-claims matters and any claim if you have opted out of arbitration), you and Raid Train Express consent to the exclusive jurisdiction of the state and federal courts located in Oregon.
14. Dispute Resolution & Arbitration
Please read this section carefully — it affects your legal rights, including your right to file a lawsuit in court.
Informal resolution first. Before filing a claim, you agree to first contact us at legal@raidtrainexpress.com with a written description of the dispute. We will try in good faith to resolve it informally. If the dispute is not resolved within 30 days of your notice, either party may begin arbitration as described below.
Binding arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section. Arbitration will be conducted by a single arbitrator, in English, and may be conducted by videoconference or, if an in-person hearing is required, in the county where you reside or another mutually agreed location. The arbitrator's award may be entered in any court of competent jurisdiction.
Exceptions. Either party may (a) bring an individual claim in small-claims court, or (b) seek injunctive or other equitable relief in court for infringement or misuse of intellectual property rights or unauthorized access to the Platform.
Class action waiver: you and Raid Train Express agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, and the remainder shall be arbitrated.
30-day opt-out. You may opt out of this arbitration agreement by emailing legal@raidtrainexpress.com within 30 days of first accepting these Terms (or within 30 days of the effective date of this section, if you accepted an earlier version), stating your account email and that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.
Fees. Payment of AAA filing, administration, and arbitrator fees will be governed by the AAA Consumer Arbitration Rules. We will not seek attorneys' fees or costs from you in arbitration unless the arbitrator determines your claim was frivolous.
15. Changes to Terms
We may update these Terms with notice via email or in-app notification. Continued use after changes constitutes acceptance.
